Welcome to Isle of Gaia. These Terms of Service (“Terms”) apply to your use of our website and purchases made from Isle of Gaia LLC (“Isle of Gaia,” “we,” “us,” or “our”). By accessing our website, placing an order, or purchasing our products, you agree to these Terms, along with our Return and Refund Policy, Shipping Policy, Privacy Policy, and any other policies posted on our website.

Products & Availability

Isle of Gaia offers products that may include live plants, roses, fresh-cut flowers, bouquets, floral arrangements, custom floral products, botanical goods, and other merchandise.

Because many of our products are living, natural, seasonal, or handmade, variations in size, shape, color, foliage, bloom stage, and overall appearance are expected. Product photographs are intended to provide a general representation and may not depict the exact plant or floral product you receive unless specifically stated.

Live plants and roses are not guaranteed to be in bloom at the time of purchase or delivery. Flowers, foliage, and other botanical materials used in arrangements may vary based on seasonal availability. When necessary, substitutions may be made while maintaining the overall style and value of the arrangement.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or cancel an order if an item becomes unavailable. If we cancel an order because we cannot fulfill it, the applicable amount paid for the canceled item will be refunded.

Live Plants & Plant Health

Live plants may experience temporary stress during transportation, including minor leaf loss, yellowing, dropped blooms, damaged leaves, or other cosmetic changes. These conditions do not necessarily indicate that a plant is unhealthy or dead on arrival.

Many of our plants are grown outdoors. We take reasonable preventative measures and inspect plants before they leave our care; however, we cannot guarantee that live plants will remain completely pest-free. Customers are encouraged to inspect, quarantine, and properly acclimate new plants before introducing them to an existing collection.

Once received, the customer is responsible for providing appropriate care based on the plant’s individual needs and growing conditions.

Orders & Payments

By placing an order, you agree that all information provided during checkout is accurate and complete. This includes your name, shipping address, billing information, email address, and other requested information.

Customers are responsible for reviewing their order and shipping information before completing a purchase.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including in cases of suspected fraud, payment issues, pricing errors, inventory errors, or product unavailability.

Shipping

Orders are shipped according to our current Shipping Policy. Shipping schedules may vary depending on product type, weather conditions, order size, holidays, and carrier availability.

Customers purchasing live plants are responsible for considering weather conditions at both the shipping origin and destination before placing an order.

Carrier delays and other circumstances outside our reasonable control may affect delivery times. Please refer to our Shipping Policy for additional information regarding live plant shipping, weather, delivery, and damaged shipments.

Returns, Refunds & Final Sale Items

Due to their delicate and perishable nature, live plants, roses, fresh flowers, bouquets, floral arrangements, and custom floral products are final sale and are not eligible for standard returns or exchanges.

Claims involving plants that arrive dead or orders that arrive significantly damaged must follow the requirements and reporting timeframe outlined in our Return and Refund Policy.

Custom and made-to-order floral products are non-refundable once preparation or design work has begun.

Any eligible non-perishable merchandise is subject to the terms outlined in our Return and Refund Policy.

Custom Orders

Custom floral designs and other made-to-order products may require advance payment or a deposit.

Once materials have been purchased or preparation and design work has begun, custom orders may not be canceled or refunded.

Because flowers and botanical materials are seasonal products, exact varieties and colors may be subject to availability. When substitutions are necessary, we will make reasonable efforts to preserve the overall style, color palette, and value of the requested design.

Intellectual Property

All original content appearing on the Isle of Gaia website, including our business name, branding, logos, original photographs, graphics, written content, product descriptions, and original designs, is owned by or licensed to Isle of Gaia LLC unless otherwise stated.

Our original content may not be copied, reproduced, distributed, republished, or used for commercial purposes without prior written permission.

Website Use

You agree not to misuse our website, interfere with its operation, attempt unauthorized access, use the website for unlawful purposes, or engage in fraudulent activity.

We reserve the right to restrict access to our website or services when reasonably necessary to protect Isle of Gaia, our customers, or our website.

Limitation of Liability

To the fullest extent permitted by applicable law, Isle of Gaia LLC will not be responsible for indirect, incidental, or consequential losses resulting from the use or misuse of our products.

Live plants and flowers are affected by environmental conditions and individual care practices. We cannot guarantee the continued health, growth, flowering, or survival of a live plant after delivery when factors affecting its care and environment are outside our control.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be limited under applicable law.

We may update these Terms of Service periodically to reflect changes to our products, services, business practices, or legal requirements. The version posted on our website at the time of use will apply, subject to applicable law.

Governing Law

These Terms are governed by the laws of the State of Florida and applicable federal laws of the United States, without limiting any consumer rights that may apply under applicable law.
